The U.S. Senate passed the Employment Nondiscrimination Act (ENDA) by a vote of 64-32 on November 7.
Current federal law bars employers from discriminating against candidates or employees on the basis of their race, sex, or national origin. However, the law does not prohibit employers from firing or refusing to hire workers because they are lesbian, gay, bisexual, or transgender.
ENDA would apply to employers with 15 or more employees. The legislation would prohibit these employers from making hiring, promotion, firing, or compensation decisions based on the candidate’s or employee’s sexual orientation or gender identity. In addition to exempting small businesses, the legislation also exempts religious organizations and the military.
