The U.S. Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) recently said it will be reviewing employers’ consideration of candidate criminal history for systematic discrimination.
In a directive issued on January 29, OFCCP said it adopts the Equal Employment Opportunity Commission’s (EEOC’s) 2012 enforcement guidance on this issue.
Jackson Lewis LLP reports that this guidance requires employers to “conduct an individualized assessment of the job-relatedness of a conviction to the job to which the candidate applied.”
The directive applies to all covered federal contractors and subcontractors.
